Landlord and Tenant Disputes

Whilst being a landlord or indeed a tenant, may issues can arise. We can help with some of these to ensure a tenancy runs smoothly for both landlord and tenant.

 

Tenancy agreement

We can provide advice to both landlords and tenants on the terms of their tenancy agreement to ensure that the parties are aware of what they are entering into. We can also suggest terms that you may want to include or delete from the tenancy agreement to make it more efficient.

 

Payment of rent

If as a landlord you experiencing difficulties in obtaining rent from your tenants we can assist with rent recovery. We can also advise tenants on when they may be entitled to withhold rent.

 

Obligations during the tenancy

We can advise both landlords and tenants on what they must and must not do during a tenancy agreement. We can also assistant when either party has breached on obligation under the tenancy agreement and advise on how to enforce a term of the agreement.

 

Deposits

All deposits taken for an assured shorthold tenancy must be placed within a government approved tenancy deposit scheme. We can advise landlord’s on this and the implications of failing to do. It is also important for tenants to know whether their deposit has been protected and we can assist with this. Should a dispute arise over whether or not a deposit should be returned we can advise both landlords and tenants on this.

 

Possession proceedings

Again we can act on behalf of both landlord and tenant in possession proceedings. Whilst acting on behalf of landlords we can advise on whether there are grounds to seek possession of a property, draft notices to serve on tenants, commence possession proceedings at court and arrange for representation at court hearings. If a tenant is faced with possession proceedings we can assist in defending these and again arrange representation.
